Introduction

These Terms of Use govern your access to and use of greendopamine.eu (the “Site”), operated by Kweri BV trading as Green Dopamine. By accessing or using the Site, you agree to these Terms.

If you do not agree to these Terms, please do not use the Site.

These Terms are read together with our Privacy Policy and Cookie Policy, both of which form part of these Terms by reference.

What the Site is for

The Site exists to describe Green Dopamine’s services, network, and approach to the creator economy. It is intended for commercial and professional audiences, including brands, creators, nurseries, breeders, expos, and other parties interested in strategic engagement with Green Dopamine.

The Site is informational. It is not a transactional platform. Pages, content, and information on the Site do not constitute a binding offer, contract, or commitment by Green Dopamine.

Scope of these Terms

These Terms govern your use of the Site only. Any commercial engagement with Green Dopamine, including brand partnerships, creator activations, strategy work, Asia services, deal-making, and FAB membership, is governed by separately signed agreements. Those agreements take precedence over these Terms in the event of any conflict.

Acceptable use

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Site.

You agree not to:

  • Use the Site to send unsolicited commercial communications, spam, or malicious content
  • Attempt to gain unauthorised access to the Site, its systems, or any data not intended to be public
  • Use automated tools (such as scrapers, crawlers, or bots) to extract data from the Site without our written permission
  • Reproduce, distribute, or republish any content from the Site beyond what is permitted under copyright law and our Intellectual Property terms below
  • Use the Site or its content in any way that could damage, disable, overburden, or impair its operation
  • Use the Site to harass, defame, or harm any individual or organisation

We reserve the right to restrict or terminate your access to the Site if you breach these acceptable use rules.

Intellectual property

All content on the Site, including text, graphics, logos, images, video, audio, design, and software, is the property of Kweri BV or its licensors and is protected by copyright, trade mark, and other intellectual property laws.

You may view, share, and link to content on the Site for personal, non-commercial purposes and for genuine professional evaluation of Green Dopamine’s services. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Site without our prior written permission.

Logos, brand marks, and creator names mentioned on the Site are the property of their respective owners and are used either by permission or under fair use for editorial reference. Nothing on the Site grants you any licence to use those marks.

Third-party content and links

The Site may contain links to third-party websites, services, or resources. We provide these links for convenience. We do not control, endorse, or assume responsibility for third-party content. Your use of any third-party site is at your own risk and subject to the third party’s own terms and policies.

Disclaimer of warranties

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by Dutch law, we make no warranties, express or implied, about the Site, including but not limited to warranties of accuracy, completeness, reliability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We may modify, suspend, or discontinue the Site or any part of it at any time without notice.

Information on the Site is for general informational purposes only. It does not constitute professional advice. Any decision you make based on information from the Site is your own responsibility.

Limitation of liability

To the maximum extent permitted by Dutch law, Kweri BV and Green Dopamine will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Site, including but not limited to loss of profits, loss of data, loss of business, or business interruption.

Our total liability for any claim arising from or relating to these Terms or your use of the Site will not exceed one hundred euros (EUR 100).

Nothing in these Terms limits or excludes liability that cannot be lawfully limited or excluded under Dutch law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Indemnification

You agree to indemnify, defend, and hold harmless Kweri BV, Green Dopamine, and our directors, officers, employees, and agents from any claim, loss, liability, cost, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top and, where appropriate, post a notice on the Site. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

Governing law and dispute resolution

These Terms are governed by the laws of the Netherlands.

Before any party initiates legal proceedings, both parties agree to attempt resolution in good faith through informal dialogue. If informal dialogue does not resolve the dispute within sixty (60) days, the parties agree to submit the dispute to mediation or arbitration under the rules of the Netherlands Arbitration Institute (NAI) before either party initiates court proceedings.

If alternative dispute resolution does not resolve the matter, the dispute will be submitted to the exclusive jurisdiction of the competent courts of The Hague, the Netherlands.

Nothing in this clause prevents either party from seeking urgent injunctive relief in the courts of the Netherlands.

Entire agreement

These Terms, together with the Privacy Policy and Cookie Policy referenced above, constitute the entire agreement between you and Kweri BV regarding your use of the Site. They supersede any prior agreements or communications regarding the Site.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
